Sealed bids shall be received by PENNSVILLE TOWNSHIP, hereinafter referred to as “Township,” in accordance with public advertisement as required by law, with a copy of said notice being attached hereto and made a part of these specifications. Sealed bids will be received by the township until Tuesday, June 26th, 2018 at 1:00 PM and will be publicly open and read immediately thereafter at the Pennsville Township Municipal Building located at 90 North Broadway, Pennsville NJ 08070, for the Riverview Beach Park Tennis Court Resurfacing Project. Neither the owner nor the Engineer will assume any responsibility for Bids mailed or misdirected in delivery. No bids may be withdrawn for a period of sixty (60) days from the opening of the bid.

The Riverview Beach Park Tennis Court Resurfacing Project (hereinafter referred to as “Project”) consists of, but is not limited to all labor, material and equipment necessary to complete all proposed improvements as set forth in the specifications and construction plans to repair and resurface the tennis courts located at Riverview Beach Park.

Specifications and other documents constituting the contract documents may be examined without charge at the office of Environmental and Technical Services, 822 Washington Ave, Woodbine, New Jersey 08270, 609-861-7000 between the hours of 9:00 AM and 4:00 PM. The Contract Documents may be purchased at the above office for a non-refundable fee of $75 made payable to Environmental and Technical Services. If shipping of bid documents is required bidders may provide their direct shipping account number to Environmental and Technical Services or include a non-refundable mailing fee.

The bidders are requested to submit one Lump Sum Bid for the base work as specified in the contract documents. Bids must be made on the bid forms provided within the documents in a manner designated herein.  Bids must be enclosed in a sealed envelope bearing the bidder’s name and address labeled Riverview Beach Park Tennis Court Resurfacing Project and addressed to “Pennsville Township, 90 North Broadway, Pennsville NJ 08070, Attention: Angela Foote, Municipal Clerk”.

All Lump Sum prices shall include all work and materials. Due to the nature of the work involved which can only be seen by an on-site visitation, site visits are strongly recommended and a form as such shall be completed and signed.

All bidders shall use and complete all bid forms provided in the manner designated. Proposals must be accompanied by a Certificate of Surety from an acceptable surety and a bid security in the form of a certified check, bank cashier’s check, treasurer’s check or Bid Bond in the form provided in the Contract Documents, in an amount not less than 10% of the Base Bid (but in no case in excess of $20,000.00), naming as payee or oblige, as applicable, Pennsville Township.  This amount is to be retained and applied by the undersigned as provided in Contract Documents in case bidder defaults in executing the Agreement or furnishing the required bonds and insurance certificates as required by Contract Documents. Please be advised that any bidder who does not include a “Consent of Surety” will be automatically rejected.

In accordance with applicable laws of New Jersey, the Pennsville Township reserves its right to waive informalities and to accept any bid or to reject any or all bids. The award of the contract shall be made subject to the necessary monies to do the work provided by the Township in a lawful manner. The award shall further be subject to securing the necessary state, federal and local permits governing the work.

The contractor must comply with the New Jersey Public Contracts Law 1975, Chapter  127, NJAC 17:27 Affirmative Action and New Jersey Public Law 1977, Chapter 33 Ownership Statement and must submit an Affirmative Action Plan approved by the State Treasurer before a contract may be awarded and proof of such plan with bid, if required.

The contractor must comply with the requirements of P.L. 1977 Chapter 33, listing all individuals, corporate/partnerships, or other names and addresses who have an ownership share of 10% or more.

Pursuant to Chapter 57, Laws of 2004 (s1778) all business organizations that do business with a local contracting agency are required to be registered with the State of New Jersey and provide proof of their Registration with the New Jersey Department of Treasury, Division of Revenue before the contracting agency may enter into a contract with the business. All bidders shall adhere to the information as classified as “New Jersey Business Registration Requirements.”

“The Public Works Contractor Registration Act” became effective on April 11, 2000. A copy of the certificate must be included in the bid package.
